Policy of Borofy
(i)
The following terms will
exclusively govern the Privacy Policy that Borofy has adopted to collect, use,
maintain and disclose information collected from its users (individually,
“User”) of www.borofy.com
Site, the Web Application, and any other products and services that Borofy
offers, that will collectively be termed as ‘Services’ henceforth in this
Privacy Policy.
(ii)
The terms used in this Privacy
Policy will have the same meanings as stipulated in Borofy’s Terms and Conditions, unless
otherwise defined in this Privacy Policy.
(iii)
This page contains Borofy’s comprehensive privacy policy and will override any
other privacy stipulations in any other agreements or terms.
Collection
and Use of Data
(i)
Borofy stipulates that data will
be collected and retained on a routine and regular basis in order to allow its
Users to access and use its Services.
(ii)
Unless such personal information
is provided, Borofy cannot allow its Users to access its Services, and it is in
the interests and safety of the Users that Borofy collects and retains this
information.
(iii)
The information so collected will
be used for providing these Services and for improving them, for providing
better customer services, for providing more efficient support, for enhancing
response time, to personalize User experiences, to understand how our Users as
an aggregate use our Services, and to improve our Services.
(iv)
This information and data will
not be used or shared except in such a manner as set out in this Privacy
Policy.
Storage and Use of Data
(v)
We guarantee that we
adopt appropriate data collection, storage and processing practices and
security measures to protect against unauthorized access, alteration,
disclosure or destruction of your personal information, username, password,
transaction information and data stored on our Site.
(vi)
We do not sell, trade, or
rent Users personal identification information to others. We may share generic
aggregated demographic information not linked to any personal identification
information regarding visitors and users with our business partners, trusted
affiliates and advertisers for the purposes outlined above.
(vii)
The information uploaded and
submitted by Users will be editable to them in accordance with existing privacy
laws, for which Users can contact Borofy’s customer
support through phone or email, as given below.
Data to
be Collected
(i)
Borofy will keep the personal
identification details provided by the User in order to complete their KYC
verification.
(ii)
These details will be stored as
per the Aadhar guidelines and will be in compliance with existing safety and
privacy norms within the jurisdiction of India.
(iii)
Borofy may also collect log data,
which includes non-personal identification information such as Users’ device
Internet Protocol (“IP”) address, device name, operating system version, the
configuration of the app when utilizing our Services, the time and date of Users’
use of the Services, and other statistics.
Third
Party Services & Service Providers
(i)
Borofy will use third party
services that may collect identification information used by Borofy in order to
facilitate, provide and enhance the Services rendered by Borofy and for
maintenance, upkeep and improvement purposes, as well as to carry out
Service-related services or provide Borofy with data analytics.
(ii)
Such information may shared only for the purpose of performing the stipulated
functions by these third party service providers.
(iii)
The links to the privacy policies
of third party service providers used by Borofy are as

(iv)
For those third
party services for whom there is no publicly available privacy policy,
Borofy will stipulate that this information so shared with them cannot be used
for any purposes besides the purpose for which such information has been
shared.
Cookies
(i)
Borofy’s
Application and Site may use "cookies" to enhance User experience.
(ii)
Cookies are files with a small
amount of data that are commonly used as anonymous unique identifiers. These
are sent to a User’s browser from the websites that the User visits and are
stored on the User’s device's internal memory.
(iii)
The User's web browser places
cookies on their hard drive for record-keeping purposes and sometimes to track
information about them. User may choose to set their web browser to refuse
cookies, or to alert them when cookies are being sent. If Users do so, some
parts of the Site may not function properly or may be inaccessible.

to Other Sites
(i)
Borofy’s
Application and Site may contain links to other sites or may have third-party
links.
(ii)
Users can click on these
links at their own discretion and liability.
(iii)
Upon clicking these
links, Users will be directed to these third-party sites which are not operated
by Borofy and hence will not be governed by this Privacy Policy.
(iv)
Users will be responsible
for reading the Privacy Policies followed by these third-party sites.
(v)
Borofy bears no liability
for the content, privacy policies, or practices of any of these third-party
sites or services.
Security
(i)
Borofy undertakes to use all
commercially acceptable means of storing, using and protecting the data
retained by it.
(ii)
However, owing to the inherent
risks associated with transmission and storage of data especially by electronic
means, Borofy cannot guarantee absolute security.
(iii)
Hence Borofy will not be liable
for any breach of security measures provided Borofy has taken reasonable
precautions for the safety and security of the data retained by it.
(iv)
Borofy will also not be held
liable when the User themselves has acted in a manner either by commission or
omission to breach this Privacy Policy or to render it invalid.
Children’s Privacy
(i)
Borofy does not offer its
services to those below 18 years of age and the Terms of Use explicitly
disqualifies minors from using the Site and the Application.
(ii)
Borofy does not and will not
intentionally or knowingly collect personally identifiable information from
children under 18.
(iii)
In case Borofy discovers that the
personal information of a child under 18 has been provided to us, we will immediately
delete this from our servers.
(iv)
The responsibility and liability is on the parent or guardian of the child to contact Borofy
and inform us of the same so that we may take necessary action, if you’re aware
that your child has provided us with such information.
(v)
Where the parent is aware of the
child having provided such information, or having falsely created an account with
Borofy, and if the parent does not choose to inform Borofy, Borofy will not
accept any responsibility or liability arising out of Borofy being provided
with such information.
(vi)
Borofy will not be liable for any
breach, injury or consequence arising out of Borofy being provided with such
minor’s information if Borofy is not aware that the User is a minor.
Amendments
to the Policy
(i)
This page may be updated
from time to time to reflect changes in Borofy’s
privacy policy that will either be at the discretion of Team Borofy or be done
in order to reflect changes in the governing laws of India.
(ii)
Any changes made to this
page will be intimated to each User and it is on each User to read and understand
the changes.
(iii)
Users accept the responsibility
of reviewing this page periodically for any changes.
(iv)
The amendments will be deemed
effective and operational immediately after they are posted on this page.
Indemnity Clause
Users
agree to indemnify and to hold Borofy, its team, its officers, subsidiaries,
affiliates, successors, assigns, directors, officers, agents, service
providers, suppliers and employees, harmless from any claim or demand,
including reasonable attorney fees and court costs, made by any third party due
to or arising out of the User’s acts of commission or omission that constitute
a breach of this Privacy Policy, due to the User’s use of the service, or due
to the User’s violation of any rights of any other party.
Agreement
of Users
(i)
By using Borofy’s Site and Application, Users signify their
acceptance of this Privacy Policy and Terms of Use.
(ii)
If you are in
disagreement with this Policy, do not use our Site or Application.
(iii)
Continued use of our Site
or Application will be considered acceptance of our Privacy Policy.
(iv)
Your continued use of the
Site or Application following the intimation of changes to this policy will be
deemed your acceptance of those changes.
(v)
By choosing to use our Services,
you agree to the collection and use of information in relation to and in the
manner set out in this policy.
